Conditions of Boat Parking
Boat parking is provided to Club members who use their boat on a regular basis. With demand for boat parking exceeding supply the Committee reserves the right to deny renewal or continued allocation of a boat park to those who did not average at least 2 sails per month between October and May.
Entitlement to Boat Parking
Allocation of boat parks is at the complete discretion of the Club and the Club reserves the right to refuse any application for parking and to cancel the boat parking agreement during the period. If the Club accepts the owner's application, the owner will be entitled to park their boat in the allocated space for the period covered by the payment, subject to the CYC Boat Storage Policy (Available at the CYC Office). The allocated space may only be used for the storage of the boat as indicated on the owners application form, unless otherwise agreed by the CYC Office Manager.
Owners Responsibilities
Owners are to:
(A) - Ensure their boat is reasonably secured in it's allocated space and will not pose a danger or cause injury.
(B) - Ensure the boat and boat space is clean and tidy at all times. Only fitted, canvas or like material boat covers may be used, ie. no loose sheets, tarpaulins or ground covers.
(C) - Ensure there is no outboard motor stored on or in the boat, or anything else of value which might tempt thieves.
(D) - Insure the boat against third party injury and property damage to a minimum of $5 000 000.
Change of allotted boat space
The club may change the space allocated to the owner if the club considers it in the interest of efficient boat parking to do so.
Change of boat ownership or removal
If the boat ownership changes or the owner permanently removes the boat, the boat park will revert back to the club. In this case you may request a pro-rata re-imbursement of fees for unused periods of over 3 months. In the case of a new owner, he/she must apply for a parking space.
Liability
The owner acknowledges that boat parking is at the owners risk. The CYC accepts no responsibility for loss of or damage to the boat, trailer, contents, fittings or accessories.
Termination
If the owner fails to comply with the boat parking policy, the Club may terminate the boat parking agreement by notice in writing to the address last known on the clubs records, and require removal and collection of the boat within 7 days of the date of the notice on a business day by 4pm. If not removed within the prescribed time the club may take action in accordance with the ACT Uncollected Goods Act, which may result in the disposal of the boat.
